A Seafarer in Davao del Norte received $35,167.51 separation pay and disability benefit through the Singe Entry Approach (SEnA) facilitation of the Regional Branch.
A certain male seafarer, which shall be referred as “Juan” on this article, filed a request for assistance (RFA) against Crossworld Marine Services Inc., in behalf of Kapa (Cyprus) LTD / Grimaldi Euromed, S.p.A., last September 15, 2020 for money claims on disability benefits, attorney fees, and damages. On his last voyage with the ship MV Gran Bretagna, he suffered a sudden onset of low back pain with numbness over his left lower extremity. He returned to the Philippines and had a Magnetic Resonance Imaging (MRI) on his spine and found out his impending disability. On February 2020, Juan was given a certificate of final assessment of disability.
On the initial conference of Juan and Crossworld Marine Services Inc. last September 22, 2020, which was handled by Supervising Labor Employment Officer Nancy L. Lasquite, the management were willing to compensate Juan the equivalent compensatory benefit of his disability amounting to 7,465 USD. In turn, Juan requested a higher amount of compensation in consideration for his 10 years of faithful services and that he needed to take care of his children. He also raised another issue regarding his unpaid 10 days sick leave.
With the foresight and hopes that the case will be amicably resolved, Lasquite allowed the conciliation conferences to continue between the two parties. On their last conference on December 15, 2020, the principals of Crossworld Marine Services Inc., settled to pay Juan 35,000 USD as well as his sick leave equivalent amounting to $167.51.
