Seafarer Receives 1.18 M as Monetary Benefit through VA
Mr. Roy Abrio Tan, the complainant received a total amount of One Million One Hundred Eighty Eight Thousand Seven Hundred Twenty Six Pesos (1,188,726.00) from Great Southern Maritime Services Corp., MSI Ship Management Pte. Ltd. through Voluntary Arbitration on the issues of 1. Whether complainant is entitled to permanent total disability benefit; and; 2. Whether or not complainant is entitled to sickness allowance.
On January 19, 2017, Mr. Tan, formerly employed as seafarer and Great Southern Maritime Services Corp. submitted to NCMB a duly signed submission agreement for Voluntary Arbitration. Parties chose panel of Voluntary Arbitrators namely Atty. Rolando P. Arañas, Chairman of the Panel, Atty. Ronieto B. Bata, member of the panel and Atty. Danilo A. Cullo. Hence, the case was then docketed as PAC-325-RCMB-XI-MVA-02-01-01-2017.
As stated in the facts of the case:
“…on March 16, 2015, Complainant Roy A. Tan boarded vessel MT Maritime Gisela, an oil/chemical tanker at Jinglang, China while the ship was dry-docked.
On May 15, 2015, while the ship was underway to U.S.A., Tan was sweeping in the main deck and something went into his right eye.
On June 15, 2015, he was diagnosed for Synechia 360¡ and declared unfit for duty due to poor vision in his right eye…”
On July 26, 2017, after the parties submitted their respective position paper, the said panel rendered their decision citing ruling, jurisprudence and CBA provision in favour of complainant and against the respondents ordering them to pay complainant Roy A. Tan the amount of US$20,900 as permanent disability compensation and US$2,340 for sickness allowance.
On October 18, 2017, parties entered into a compromise agreement and settled the issues in favour of the complainant.
