DAVAO CITY. The Regional Conciliation and Mediation Branch XI settled labor dispute at Radio Mindanao Network, Inc. – Davao against its labor union, RMN Davao Employees Union (RDEU) last November 13, this year.

According to RCMB XI OIC Director Ma. Theresa M. Francisco, “After going through a crucial deliberation of terms and conditions of settlement that lasted for 48 hours, finally this Office, together with the guidance and valuable efforts of Honorable Executive Director IV Reynaldo Ubaldo, the parties inked their settlement through a Memorandum of Agreement (MOA).”

Salient features of the Agreement cited that all striking union members shall immediately report back to work and for the management to accept all the returning strikers under the same terms and conditions of employment before the strike. Also, no retaliatory actions shall be taken by either party against each other as a result of strike. The existing labor, criminal, civil and administrative case filed by the parties against each other shall be allowed to take its due course.

After the signing of said MOA the union immediately lifted the picket line, cleaned and removed all posted placards and streamers, the established makeshifts, as well as other protests paraphernalia in three worksites including the RMN main studio, AM and FM transmitters, respectively.

Among the negotiated issues of the Memorandum of Agreement includes the resumption of the CBA negotiation after ten (10) days of the signing of the MOA and the opening of the six (6) vacant positions (3 from AM station & 3 from FM station) of which union will recommend qualified applicants subject to the hiring policy and procedure standards of RMN management.

On August 14, 2014, RDEU filed a Notice of Strike case docketed as NCMB-RBXI-NS-08-004-2014 (DDS) on the grounds of: 1.) Refusal to bargain on the issue of Ground Rules specifically on the composition of panel in the CBA negotiation; 2.) CBA violations particularly on the non-observance of grievance procedure, on work assignment and on job security; and 3.) Union busting pertaining to contracting out of services performed by regular union members necessary and desirable to the operation, and employing workers without appointment or creating position not in the company’s organizational structure.

The union conducted strike vote referendum and submitted the official strike vote result in this Office on August 26 in favor of a strike.

On October 2, they staged strike and barricaded three worksites such as RMN main studio along Anda corner Bonifacio Streets; AM transmitter at Madapo Hills; and FM transmitter at Shrine Hills in Matina, all in Davao City.

RMN Davao Employees Union (RDEU) is affiliated with National Federation of Labor Union (NAFLU) and Kilusang Mayo Uno (KMU) which represents 17 rank-and-file employees and was headed by Ms. Gina Hitgano, union president.

Meanwhile, Radio Mindanao Network, Inc. – Davao, located along Anda corner Bonifacio Streets, this city, is one of the largest radio broadcasting companies in the region with 31 total workforce.
