The Regional Branch Supervising Labor Employment Officer successful facilitated the labor dispute at Franklin Baker Company of the Philippines last June 8, 2021.
The Union, Nagkahiusang Mamumuo sa Franklin Baker, filed a preventive mediation (PM) against Franklin Baker Company of the Philippines (FBCP) last May 3, 2021 for Unfair Labor Practices, particularly the alleged exclusion of some workers, specifically office and technical category employees, from the Collective Bargaining Agreement (CBA) of the Union. The Branch scheduled the first conciliation conference on May 7, 2021.
In one of the conferences, the Union was privately apprised of Article 253 of the Labor Code, which stated that parties cannot modify or terminate the existing Collective Bargaining Agreement. They can only do this during the freedom period or 60 days prior to the expiration of the CBA.
Franklin Baker’s management also expressed their stance that membership cannot be tackled during their current CBA. Instead, they conceded to refer to their top management to include the negotiation on membership during the freedom period. The freedom period or the renegotiation of the CBA starts on December 2021.
On June 8, 2021, both parties agreed to revisit this issue as an item during their CBA renegotiation.
This PM case was assigned to the Branch’s Supervising Labor Employment Officer, Ms. Nancy L. Lasquite, as part of the NCMB succession program which aims to develop its employees by allowing them to handle multiple responsibilities. This PM case has successfully reached settlement.
