Davao Conciliator sprints settlement of multiple issues in Banana Company
Davao City – The National Conciliation and Mediation Board, Regional Branch XI successfully facilitated the settlement of the labor dispute between SUMIFRU (Phils.) Corp.-Salaysay Operation and UBC SUMIFRU-Salaysay Workers Union-Associated Labor Union-Trade Union Congress of the Philippines in two (2) settings only.
Conciliator –Mediator Aerrine Marie Reyes effectively eased the resolution of the parties though her perseverance, focused and hard work.
Quoting from the report of OIC-Director Ma. Theresa M. Francisco, the conciliation with multiple issues on non-compliance of CBA provisions on Grievance Machinery, Wage reclassification, non – payment of wages and hiring/employing agency workers, was extensively resolved in two (2) settings only. After which, both parties collegially agreed to address and comply the settlement agreement they signed.
As a background, On June 10, 2016, the Union filed a Preventive Mediation case for unfair labor practice specifically on the grounds of 1) Violation of Article XV of the CBA (Grievance Machinery); 2) Wage re-classification as industrial or agricultural; 3) Non-payment of wages of 56 workers on June 15, 2015; 4) For hiring/employing agency workers.
On June 21, 2016, it was validated that the issues were in relation to the non-implementation of the grievance procedure of the parties as provided for in their CBA; reclassification of wages as industrial or agricultural; non-payment of wages on June 16, 2016; and hiring of agency workers.
After an extensive discussion with the assistance of Conciliator-Mediator Aerrine Marie R. Reyes, the union decided to drop the issue on wage reclassification reducing the issues to only 3 items for possible resolution.
On June 30, 2016, parties finally agreed on the three issues and its corresponding settlement.
On the issue of grievance procedure, there should be one or two meetings of the union and management representatives prior to the implementation of administrative decision/sanction.
On the issue of non-payment of salaries of fifty six (56) workers on June 16, 2015, total claims shall be included in the payroll cut-off and will be paid on July 9, 2016.
Lastly, on the issue of hiring of agency workers, the management committed to comply with what is mandated by law.
Hence, the said preventive mediation case was deemed settled and closed from the business calendar of the branch effective June 30, 2016.
