Davao City – Regional Conciliation and Mediation Branch 11 settled labor dispute between parties LFC-Integrated Supervisors Union-APSOTEU and Lapanday Foods Corporation on August 27, 2015.
“As settlement of the case, the parties agreed to conduct a reinvestigation at the plant level through Grievance Machinery to give the Union a chance to participate in the process by presenting new pieces of evidence,” according to Conciliator-Mediator Aerrine Marie Reyes who facilitated the resolution of the case.
“If any, which are not being considered by the management when it conducted its investigation on the alleged chemical pilferage committed by Mr. Emmanuel Baltazar,” ConMed Reyes added.
On June 10, 2015, the Union filed a case against the company on the ground of unfair labor practice for the violation of CBA provisions namely: management prerogative and grievance procedure.
The case was then docketed as RCMB-XI-DDS-PM-06-017-2015.
The issue raised by the Union was relative to the alleged chemicals pilferage made by Mr. Emmanuel Baltazar by engaging in illegal loading of the said substance in his boarding house.
The incident took place early in the morning of March 21, 2015 and was narrated in the Incident Report prepared by the security guard on duty.
The member-union Mr. Baltazar then was placed under 30-day preventive suspension from March 25 to April 24, 2015.
On June 19, 2015, Mr. Baltazar received the Notice of Sanction that manifests his dismissal from service without grievance machinery due process.
The Union requested the management to convene the Grievance Committee through letter-requests for two occasions but the management failed to respond with the Union’s request for grievance.
After series of conciliation conferences, the parties have finally drafted an amicable settlement.
LFC-Integrated Supervisors Union-APSOTEU, affiliated with Associated Labor Union (ALU), represents 50 member-supervisors for collective bargaining purposes and was headed by Atty. Fortunato Maranian, ALU-SMR regional vice president.
On the other hand, Lapanday Foods Corporation, engaged in banana plantation and exportation, is located at Maryknoll Drive, Bo. Pampanga, Davao City. It was represented by Mr. Hernani Geronimo, Strategic Human Resources and Shared Services department head.# (Dennis M. Galorio, LIO)
