Davao City – The National Conciliation and Mediation Board, Regional Branch XI OIC-Director Ma. Theresa M. Francisco settles labor dispute at once between Nakayama Organization of Workers-Southern Philippines Federation of Labor and Nakayama Technology Corporation docketed as RCMB-XI-DDS-PM-02-001-2016.

On February 17, 2016, the Union filed a Preventive Mediation case against Nakayama Technology Corp. on the issues of Unfair Labor Practice for 1. Violation of Collective Bargaining Agreement (CBA) particularly on Article XII Section 2 – Labor Management Cooperation (LMC); Article XII Section 3 – T-shirt and Art. XII Section 9 – Lockers and 2. Article 100 of the Labor Code: Diminution of Benefits/Old practice on rice subsidy.

On February 24, 2016, as the initial conference, the issues were validated.

On the same date, both parties settled amicably on all the issues. On the first item, Art. XII Sec. 2, parties agreed to implement in their LMC program the grounds rules based on the conceptual framework as provided by NCMB that includes the conduct of monthly meetings which they chose to schedule every first Saturday of the month inside the company premises.

On Article XII, Sec. 3 which is the provision of t-shirt as their uniform, parties also agreed to acquire a new one and discuss any amendments at the plant-level to come up with a company policy on uniforms.

On Article XII, Sec. 9, the management offers a locker for the union.

Lastly, the grant of rice subsidy to the workers which is considered an old practice according to the union shall be raised to top management.

In view of the foregoing, the said case was deemed settled and closed from business calendar of this office on February 24, 2016.

The branch facilitated the conciliation and settled the instant preventive mediation case in one (1) setting only.
